Learned counsel for the petitioners requests for withdrawal of the petition with liberty to file a fresh one on the same cause of action, if the petitioners are able to place on record the material showing that their initial appointment was made in accordance with the rules or requirements of articles 14 and 16 of the Constitution as has been laid down by the constitution Bench judgment of the HON BLE Supreme Court in the case of secretary, State of Karnataka and others V/s. Umadevi and others, JT 2006 (4) SC 420. 2. The prayer made by the learned counsel is accepted and the writ petition is dismissed as withdrawn in terms of the prayer made.
