Judgment :- (Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondents to upgrade the petitioner as Grade. I Police Constable after completion of 10 years service as Grade. II Constable and further upgrade as Head Constable after completion of 5 years service in Grade. I Police Constable in pursuance to the Government Order issued in G.O.Ms.No.844, Home (Police V) Department, dated 03.06.1997 and grant all consequential service and monetary benefits. ) This writ petition has been filed for a direction against the respondent to upgrade the petitioner as Grade. I Police Constable after completion of 10 years service as Grade. II Constable and further upgrade as Head Constable after completion of 5 years service in Grade. I Police Constable in pursuance to the Government Order issued in G.O.Ms.No.844, Home (Police V) Department, dated 03.06.1997. 2. Even though as per the communication of the second respondent, the Director General of Police, dated 25.10.2004, it is stated that a proposal has been sent in respect of 94 police personnel who were appointed in the year 1989 and educationally qualified for upgradation promotion as Gr.I PC and the said proposal was sent as early as on 24.11.2003. While considering the same, this Court by an order dated 26.06.2006, passed in W.P.No.19337 of 2006 batch has directed to pass consequential orders within a specified time. 3. I have heard the learned counsel for the petitioner and the learned Government Advocate who have taken notice on behalf of the respondents. 4. Considering the said communication of the second respondent, dated 25.10.2004, if the petitioner comes one among the 94 police personnel, in respect of whom the proposals have been sent, the first respondent is directed to pass appropriate orders conferring the promotional benefits in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. The writ petition is disposed of on the above terms. No costs.
