Judgment :- (Writ Petition filed under Article 226 of Constitution of India praying for the issuance of Writ of Mandamus directing the respondents herein to consider and pass orders on the representation dated 17.1.2006 submitted by the petitioners 1 and 2 and the representation dated 6.1.2006 submitted by the petitioners 3 to 5 and 7 and the representation dated 12.1.2006 submitted by the sixth petitioner herein seeking for re-fixing of seniority in the inter-se seniority list of District Employment Officer on merits and in accordance with law.) This writ petition has been filed for a direction against the respondents to consider the representation of the first and second petitioners dated 17.1.2006 and the representation submitted by the petitioners 3 to 5 and 7 dated 6.1.2006 and the representation submitted by the 6th petitioner dated 12.1.2006 seeking for re-fixing of seniority in the inter-se seniority list of District Employment Officer on merits and in accordance with law. 2. By consent of either side the writ petition itself is taken up for final hearing and disposal. 3. According to the petitioners when they were holding the post of District Employment Officer, there was excess direct appointment, which has resulted in detriment suffered by them in the inter-se seniority among them. In this regard they have made representations to consider them by re-fixing the inter-se seniority in the cadre of District Employment Officer and also for the consequential retrospective promotion in the cadre of Assistant Director. 4. Heard the learned counsel for the petitioners as well as the learned Government Advocate for respondents. 5. Considering the above facts and circumstances of this case, the respondents are directed to consider the representation submitted by the first and second petitioners dated 17.1.2006, the representation submitted by the petitioners 3 to 5 and 7 dated 6.1.2006 and the representation submitted by the 6th petitioner dated 12.1.2006 and pass appropriate orders within a period of four weeks from the date of the receipt of a copy of this order. The writ petition is disposed of accordingly. No cost.
