Judgment :- (Petition filed under Article 226 of the Constitution of India praying for the issue of a Writ of Mandamus to direct the 1st respondent to regularise the services of the petitioner in the post of Lecturer in the Department of English Language studies Madurai Kamaraj University from 14.9.1998 with all attendant benefits.) By consent of the counsel appearing for the petitioner as well as the respondents, the writ petition itself is taken up for final hearing. 2. The prayer in this writ petition is to direct the 1st respondent to regularise the services of the petitioner in the post of Lecturer in the Department of English Language Studies, Madurai Kamaraj University from 14.9.1998 with all attendant benefits. 3. Heard the learned counsel appearing for the petitioner as well as the respondents. 4. It is stated by the petitioner that he is working as a Teaching Assistant in the Department of English Language Studies, Madurai Kamaraj University from 14.09.1998. He has also obtained Master of Arts Degree in English Language Studies with University First rank, M.Phil. in English Language Studies with distinction and submitted Ph.D. thesis on English Language Teaching on 24.04.2001 and published two books and five articles in the International Journals and presented seven papers in various seminars. 5. It is further stated by the petitioner that by an order dated 21.9.1998, he has been appointed as a Resource Person on temporary basis in the Department of English Language Studies with effect from 14.9.1998 till the end of the academic year 1998-99 on a consolidated honorarium of Rs.1750/- per month. Subsequently, by an order dated 21.7.1999, the petitioner has been appointed as Teaching Assistant for the academic year 1999 - 2000 on a consolidated pay of Rs.5,000/- per month. 6. Meanwhile, the first respondent has issued an advertisement in the daily newspaper "The Hindu", dated 30.01.2006, calling for applications for the post of Lecturers in various Departments of the Madurai Kamaraj University, Madurai, including the Department of English and Comparative Literature. 7. Mr.S. Sethuraman, learned counsel appearing for the respondents had stated that even though the last date of receipt of the duly filled applications was 27.2.2006, the petitioner could be permitted to send the application which would be duly considered on merits. 8.

On such submission being made, the petitioner is permitted to submit his application for the post of Lecturer in the Department of English and Comparative Literature in the Madurai Kamaraj University, Madurai, within two weeks from the date of receipt of a copy of this order. It is made clear that the petitioner's application would be considered on merits along with the other applications which have already been received by the first respondent . 9. With the above observation, the writ petition is disposed of. No costs. Consequently W.P.M.P.No.17247 of 2006 is closed.
