JUDGMENT 1. - Heard learned counsel for the applicant and the learned Public Prosecutor and also perused the material made available to me during arguments. 2. It has been alleged that.600 gm. heroin was recovered from the possession of the applicant. However on chemical examination the sample gave positive tests for the presence of chief constituents of opium having 19.30% morphine, hence the sample was found to be preparation of opium. It has been further stated in the FSL report that the sample did not give positive tests for the presence of heroin. 3. In view of the FSL report and taking into consideration all the facts and circumstances of the case I deem it just and proper to release the accused applicant on bail under Section 439 Cr.P.C. 4. It is, therefore, ordered that the accused applicant Babu Lal S/o Shyoram in FIR No. 144/2005, Police Station Cheepa Badod shall be released on bail; provided he furnishes a personal bond in the sum of Rs. 15,000/- with one surety bond in the like amount to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so during the pendency of the trial against him.Bail allowed on surety and personal bonds for Rs. 50,000/-. *******
