Judgment 1. Ms. Daya Chaudhary, learned counsel for the respondents has pointed out that under Sec.26 of the Army Act, 1950 , read with para 364 of Regulations, the remedy of statutory complaint is available to the petitioner. 2. In view of the above, learned counsel for the petitioner requests for withdrawal of the petition in order to enable him to avail the alternative remedy. C. W. P. No.18129 of 2005 (Oandm) [2] the writ petition is dismissed as withdrawn with liberty in terms of the prayer made.
