Section 5 of the Limitation Act does not say that such discretion can be exercised only if the delay is within a certain limit. Sometimes delay of the shortest range may be un condonable due to want of acceptable explanation whereas in certain other cases delay of very long range can be condoned as the explanation thereof is satisfactory, Once the Court accepts the explanation as sufficient it is the result of positive exercise of discretion and normally the superior Court should not disturb such finding, much less in revisional jurisdiction, unless the exercise of discretion was wholly untenable grounds or arbitrary or perverse, But it is different matter when the first Court refuses to condone the delay. In such cases, the superior Court would be free to consider the cause shown for the delay afresh and it is open to such superior Court to come to its own finding even untrammeled by the conclusion of the lower Court." 10. The words of the explanation are clear and unambiguous. They clearly indicate the suggest that if an appeal has been preferred and the same had been dismissed on any ground other than the withdrawal of the appeal, the same would cause as bar top the filing of the application under Order 9 Rule 13 CPC for setting aside the ex parte decree. The position of law on this point is discussed in paragraph 15 of the judgment Rani Choudhury case (1982) 2 SCC 596 . It has been observed that on a proper interpretation of the explanation, if an appeal against on ex parte decree has been filed and the appeal has been dismissed on any ground other than dismissed as withdrawn, then the application under Order 9 Rule 13 CPC would not be maintainable and cannot be entertained." ;ke lqUnj kekZ cuke iUukyky tSloky ,.M vnlZ 2005¼1½ MCY;w-,y-lh- ¼,l-lh-½ 1 esa ;g vfHkfu/kkZfjr fd;k x;k gS fd%& "It was sought to be argued on behalf of the appellant that the above decisions were distinguishable in view of the fact that in those cases, the appeals against the decrees were filed first, followed by the petitions under Order IX Rule 13 of the Code, whereas in the present cases the petition under Order IX Rule 13 of the Code was filed first and only during its pendency, an appeal against the decree was filed, within an application for condoning the delay in filing it. In our view, this would not make any difference to the principle enunciated by this Court in Rani Choudhurys case (supra). Moreover, on the day the trial Court was called upon to consider upon to consider and dispose of the petition under Order IX Rule 13 of the Code, an appeal, though belated, had been fled against the decree by the appellant and the same had been dismissed as barred by limitation and had been withdrawn. It is not possible to accept the argument that the application of the explanation should be confined to cases where an appeal had already been filed against the ex parte decree and it should be held not to apply to cases where an appeal is subsequently filed. The acceptance of such an argument, in our view, would tend to defeat the legislative scheme as noticed in Rani Choudhurys case (supra).
