JUDGMENT 1. 1. This special appeal is directed against the order of the learned Single Judge dismissing the miscellaneous appeal of the appellant as barred by limitation. The appeal was filed 46 days after expiry of period of limitation. The appellants contended that they are residents of remote area and they were not aware of the award and no sooner than they came to know about it they took steps to get certified copy and after depositing a sum of Rs. 25,000/- filed the appeal. The learned Single Judge took the view that the appellant was represented by a counsel and in the circumstances the plea of lack of knowledge cannot be accepted. It appears from the award of the Claims Tribunal that the Insurance Company has been absolved of the liability. As a result of the award the owner appellant is rendered liable to pay the entire amount of compensation to the tune of Rs. 1,52,000/-. We are of the view in these circumstances that the appellants should be given a chance of hearing in this appeal on merit. 2. We accordingly condone the delay in filing the appeal before the learned Single Judge, set aside the order impugned dated 19.10.2005 and remit the miscellaneous Appeal No. 4005/2004 (Defect) for decision on merit.Appeal Allowed. *******
