JUDGMENT 1. - The grievance of the petitioner is that despite of the fact that he is fully qualified for appointment on the post of Physical Teacher Grade-III as he is having requisite qualification as per the Rajasthan Educational Subordinate Service Rules, 1971 (for short the rules of 1971'), his form was rejected by the respondents stating therein that the petitioner has not possessed the requisite qualification for the post of Physical Training Instructor/Physical Teacher Grade-III and thus, his name was not included in the merit list. As per the advertisement issued by the respondents, necessary qualification for the post of Physical Teacher was after passing 10+2 Examination, the candidate should have 3 years Bachelor Degree and one year Degree/Diploma of B.P.Ed. (Bachelor of Physical Education) and the degree should have recognised from U.G.C. and approved by N.C.T.E. 2. It is not disputed that the petitioner passed 10+2 Examination from the Board of Secondary Education, Rajasthan, Ajmer, B.P.E. Course from Amravati University and M.P.E. (Master of Physical Education) course from Nagpur University. 3. I have perused the Rajasthan Educational Subordinate Service Rules, 1971. As per Schedule-A, Section-B, Clause (3) -Appointment on the post of Physical Training Instructor Grade-III, is 100% by direct recruitment with qualification of Secondary or Higher Secondary with certificate in physical education. 4. Admittedly, the petitioner has passed his 10+2 Examination and after passing Senior Secondary, he has done his B.P.E. Course and M.P.E. Course from Amravati University and Nagpur University respectively. 5. In view of these facts, the petitioner is eligible for consideration on the post of Physical Training Instructor Grade-III. 6. Consequently, the writ petition stands allowed and the respondents are directed to consider the case of the petitioner for the post of Physical Training. Instructor Grade-III against the-vacant post, and give appointment on the post of P.TI. Grade-III, if the petitioner is otherwise found eligible.Writ Petition Allowed. *******
