Judgment PRITAM PAL and J JJ. 1. The only contention of learned counsel for the petitioner is that the petitioner is a plaintiff before the trial Court. Her entire evidence has already been adduced and only her cross examination by the counsel for the respondent remains. It was on August 21,2005 that she was present for her cross examination, but on that date, her counsel could not appear well in time and on that ground, her evidence was closed. In this regard, learned counsel for the petitioner made reference to the orders passed separately by the trial Court on August 24,2005. Moreover, defendants evidence is yet to be recorded. 2. Thus, taking an over all view of the matter, I feel that no notice is required to be given to the respondents and as such, this Civil revision is disposed of with the direction that the trial Court shall give one opportunity to the petitioner for being cross examined by the counsel for the respondent subject to payment of Rs.1000/- as costs. A copy of this order be given dasti on payment of usual charges.
