ORDER 1. Grievance of the petitioner appears to be that he has not been promoted to the post of Assistant Fire Officer from the present post of sub-officer while in the service of the first respondent - New Mangalore Port Trust. The further grievance appears to be that respondents 3 to 5 were juniors to him and they have been promoted whereas the petitioner is denied promotion and therefore such action on the part of respondents 1 and 2 is violative of Articles 14 and 16 of the Constitution of India. 2. Petition averments inter alia indicate that there was some doubt about the caste certificate that had been produced by the petitioner, who obviously had sought employment against a post reserved for persons belonging to scheduled caste/tribe community. 3. It is not necessary for this Court to examine such question in the exercise of writ jurisdiction, particularly as to whether the petitioner was entitled to be considered for promotion or as to whether he is denied promotion without any justification while his juniors have been promoted etc. It is open for the petitioner to workout his rights in accordance with the service conditions before any other forum. It is not a matter to be investigated in writ jurisdiction. 4. Writ petition is dismissed. 5. Petition dismissed.
