Judgment M. M. KUMAR. J. 1. On august 6, 1997, a Division Bench of this Court had adjourned the instant petition sine die, as the learned counsel was to furnish some further information by filing additional affidavit. The aforementioned situation had arisen on account of non-availability of the petitioner and he was sent to commando course. The case was to be taken up as and when the additional affidavit was filed. 2. On account of the fact that Mr. Balhara, the learned counsel who had represented the petitioner had died during the pendency of the petition, we directed the Registry vide our order dated April 17, 2006 to issue actual date notice to the petitioner by sending a registered A. D. to him. The needful has been done. However, no one has appeared on behalf of the petitioner nor the petitioner himself is present. The petition is pending for the last about 9 years and no useful purpose would be served to defer the hearing any further. In view of the above, we dismiss the writ petition for want of prosecution.
