JUDGMENT 1. - It is not disputed that the present controversy is squarely covered by the judgment rendered by the Hon'ble Supreme Court in the case Sunita Sharma & Ors. v. State of Rajasthan & Ors., reported in JT 2001 (10) SC 178 , and considering the ratio decided by the Hon'ble Supreme Court in the aforementioned case, this Court in the case of Deep Chand v. State of Rajasthan & Ors., decided on 5.9.2002 and reported in 2003 (1) WLC (Raj.) 187 , also allowed the writ petition and held that appointment denied on the ground that petitioner possessed qualification of Senior Secondary (Vocational) and not Senior Secondary (Academic), both the qualifications held equal by the Supreme Court. 2. This fact is not disputed by the learned counsel for the State, as in the instant case also, the petitioner was denied appointment on the post of Teacher Grade-III on the ground that the petitioner has not possessed the requisite qualification and having only Senior Secondary (Vocational). 3. Consequently, in view of the ratio decided by the Hon'ble Supreme Court in the case of Sunita Sharma & Ors. (supra), the present writ petition stands allowed and the respondents are directed to consider the candidature of the petitioner for appointment on the post of Teacher Grade-III, if she is otherwise found eligible in accordance with the rules.Writ Petition Allowed. *******
