JUDGMENT 1. - By an application dated 25.12.1958 a grievance was raised by the petitioner that fixation of his pay in the pay scale of Rs.60-75 w.e.f. 27.5.1955 was erroneously made as he was entitled to be fixed in the pay scale of Rs.90-5-120. The petitioner submitted number of representations to the respondents but of no consequence. The respondents ultimately by communication dated 30.7.2003 closed the issue and ordered to intimate the petitioner accordingly. Being aggrieved by the same this petition for writ is preferred on 17.12.2004. 2. For a period of about 11/2 years the petition for writ was lying in defect side. Be that as it may, the claim made by the petitioner is quite stale. It is true that the petitioner was submitting representations to the respondents since 1958 but the continuous submission of representations is not a sufficient explanation to condone an inordinate delay of about 45 years. The petitioner should have approached this Court or any other legal forum for redressal of his grievance expeditiously. Looking to inordinate delay in raising the claim by the petitioner I am not inclined to interfere with the matter under Article 226 of the Constitution of India. 3. Accordingly, this petition for writ is dismissed.Writ Petition dismissed. *******
