Judgment 1. Upon this group of matters being called out, learned Advocate General, Bihar, Mr. P.K. Shahi, on behalf of the State and learned counsel for the parties were present. 2. The learned Advocate General, Mr. P.K. Shahi, stated that the Government is contemplating of formulating a policy and probably after taking a policy decision the same may be considered to be translated into legislative action. It is, really, heartening to note in view of the grievance of the petitioners voiced in this group of petitions. It is, rightly, upon consensus stated that: (1) the undertaking of the State Government for not taking coercive action upon the subjects of the Bihar Apartment Ownership Act, 2004 and Bihar Apartment Ownership Rules, 2004, in the order of this Court dated 28.9.2005, which came to be extended upon statement of learned Advocate General until hearing of the matters in this group may be confirmed, and (2) until the respondent State, which is contemplating a new policy in this behalf and thereafter putting it into legislative action in the Act of 2004, takes a final decision, the present group of matters or such other matters may be disposed of at this stage without going into the vires, legality and validity or any merits of the matters reserving the rights of the parties. 3. In terms of the aforesaid consensual statements before us, we deem it expedient at this stage, without entering into the merits of the matters in this group and similar matters that may be later on identified, to dispose of the matters by extending and confirming the interlocutory direction pursuant to the statement made on behalf of the State by the learned Advocate General without any prejudice to the rights of the parties. 4. Accordingly, all the matters in this group shall stand disposed of without any order as to cost. 5. Before parting, we are happy to place on record our sense of appreciation to the positive approach of the State and the learned Advocate General in regard to the fresh policy as submitted before us.
