Chongom Warnoi and Ors. v. State of Manipur

T.NANDA KUMAR SINGH

body2006
Heard Mr. I. Lalitkumar, learned senior counsel assisted by Mr. Boby, learned counsel for the petitioners as well as Mr. Suresh Sarangthem, learned counsel appearing for respondent nos.1 and 2. [2] These writ petitioners were appointed on 7.7.1999 under different orders issued by the DC/Chairman, District Council, Chandel. The only apprehension of the petitioners in the present writ petition is that their services are likely to be terminated vide order of the Government of Manipur being No.1/15/2000-FC dated 19th March, 2001 for the simple reason that as per the order of Government of Manipur dated 19.3.2001 all the persons appointed on direct recruitment, part-time, contract, adhoc, substitute, casual basis since 19.4.1999 are likely to be terminated. Such being the situation they approached this court by filing the present writ petition. [3] Mr. Suresh Sarangthem, learned counsel appearing for the respondents submits that the cut off date i.e. 19.4.1999 mentioned in Para no.1 of the subsequent order of the Government of Manipur dated 19.3.2001 had been changed to 6.11.1999 as per order of the Government of Manipur being No.1/15/2000-FC dated 19.6.2002, copy of which is available at Annexure-C/1 to the Affidavit-inopposition of the respondent nos.1 and 2. Mr. Suresh, learned counsel appearing for respondent nos.1 and 2 also fairly and frankly submits that since the case of the petitioners shall not be covered by the said order of Government of Manipur dated 19.3.2001 in view of the said subsequent order of the Government of Manipur dated 19.6.2002 they are not going to be terminated under the said order of the Government of Manipur dated 19.3.2001. [4] Taking into consideration of the submission of learned counsel of both the parties and also on perusal of the subsequent order of the Government of Manipur dated 19.6.2002, this writ petition is disposed of with the simple observation and direction that service of the petitioners shall not be terminated under the said order of the Government of Manipur dated 19.3.2001 because of the subsequent development i.e. the said order of Government of Manipur dated 19.6.2002. With the above observation and direction the writ petition is allowed.
