Judgment 1. The petitioner has sought transfer of the petition for dissolution of marriage under Sec.13 of the Hindu Marriage Act, 1955 , filed by the respondent and pending in the Court of Additional District Judge, Faridkot, to the Court of District Judge, Bathinda. 2. It has been pointed out that the marriage between the parties was solemnised on 20.11.2001 and that the petitioner is residing at bathinda, whereas she has invoked the jurisdiction of the Court of Judicial magistrate, Ist Class, Bathinda, for maintenance under Sec.125 Cr. P. C. The petitioner is maintaining a minor child as well and has no source of income to maintain herself and to defend the proceedings initiated by the respondent at Faridkot, after the filing of the petition claiming maintenance under Sec.125 Cr. P. C. Keeping in view the uncontroverted averments of the petitioner, the divorce petition under Sec.13 of the Act, pending in the court of Additional District Judge, Faridkot, is ordered to be transferred to the Court learned District Judge, Bathinda. It shall be open to the learned district Judge, Bathinda to entrust the case to any other Court of competent jurisdiction. The Court of learned Additional District Judge, Faridkot, shall remit the records to the transferee Court forthwith. The petitioner through her counsel is directed to appear before the learned District Judge, Bathinda, on 21.8.2006, for further proceedings in accordance with law.
