Learned counsel for the petitioners submits that the Government had issued an Addendum bearing No.51/2/92-IND dated 25th June, 2005 for adding the words “appointed against the posts created vide Manipur Handloom & Handicraft Development Corporation Ltd's order No.MHHDC/MMDH/1-A/PC/84-85, dated 11.04.1987 which are deemed to have been created by the Government” to the earlier order of the Government of Manipur being No.51/2/92-IND dated 10.06.1992 after the word “Ltd” bearing in the 4th line of the said order of the Government of Manipur dated 10.6.1992. For easy reference copy of the said Addendum dated 25.6.2005 which had been annexed as Annexure C/1 to the Misc Application (WP©)No. 57 of 2006 is quoted in entirety: “No.51/2/92-IND: Please add the words “appointed against the posts created vide Manipur Handloom & Handicraft Development Corporation Ltd's order No.MHHDC/MMDH/1-A/PC/84-85, dated 11.04.1987 which are deemed to have been created by the Government” after the word “Ltd.” occurring in the fourth line of this Government order of even number dated 10.06.1992.” [2] It is also said that after issuing the said Addendum dated 25.06.2005 the Government of Manipur under the letter of Under Secretary (Commerce & Industries), Government of Manipur being No.51/12/92-IND dated 7.7.2005 had directed the Director, Commerce & Industries, Government of Manipur that the services of 17 (seventeen) officers and staff of the Mechanized Dye House have been treated as absorbed to the Directorate of Commerce and Industries, Manipur against the posts created vide order No.51/2/92- IND dated 10.6.1992 and Addendum order of even number dated 25.6.2005, copy of which is available at Annexure-C/2 to the misc Application (WP©) No.57 of 2006 filed in the present writ petition. For easy reference the said letter of Government of Manipur dated 7.7.2005 is also quoted in entirety. “No.51/2/92-IND Imphal, the 7th July, 2005 To The Director (Commerce & Industries), Manipur. Subject: Taking over the management of Manipur Mechanized Dye House alongwith 17 staffs by the Government. Sir, I am directed to refer to your letter No.B- 1064/IND/77 (Vol.I) 508 dated 25.04.2005 on the above subject and to say that in compliance with the order dated 21.4.2004 passed by the Hon'ble Gauhati High Court in W.P© No.1243 of 2003 necessary Addendum has been issued vide this Government order of even number dated 25.06.2005 (copy enclosed).
Sir, I am directed to refer to your letter No.B- 1064/IND/77 (Vol.I) 508 dated 25.04.2005 on the above subject and to say that in compliance with the order dated 21.4.2004 passed by the Hon'ble Gauhati High Court in W.P© No.1243 of 2003 necessary Addendum has been issued vide this Government order of even number dated 25.06.2005 (copy enclosed). Hence, the services of 17 (seventeen) officers and staffs of Mechanized Dye House has been treated as absorbed to the Directorate of Commerce and Industries, Manipur, against the posts created vide order No.51/2/92-IND dated 10.06.1992 and Addendum order of even number dated 25.06.2005.” [3] Learned counsel for the petitioners submits that because of subsequent developments mentioned above, the petitioners of the present petition have now been treated as absorbed to the Directorate of Commerce & Industries, Government of Manipur. [4] In the circumstances stated above, learned counsel appearing for the petitioners submits that the petitioners are not pressing the present writ petition. [5] As submitted, the present writ petition is closed as not pressed with the above mentioned observation.
