JUDGMENT 1. - Heard learned counsel for accused petitioners, learned Public Prosecutor for the State and perused the material including the cross FIR and the injury reports of the complainant and the accused petitioners. 2. Learned counsel for accused petitioners contended that they have falsely been implicated to counter the FIR registered against the complainant. It is also submitted that on 30.7.2006 at about 1 p.m. the complainant Joru and his son Balveer entered into the house of the accused petitioner to outrage the modesty of his wife Smt. Suman Devi who was all alone in the house and when Smt. Suman Devi protested, she was beated by them, on hearing hue and cry of his wife the accused-petitioner Suresh reached at the house then he was also beated by the complainant and his son. It is also submitted that the accused petitioner Suresh received as many, as nine injuries including the injury on the vital part of his body and Smt. Suman Devi received four injuries and out of them one by sharp edged weapon. 3. Learned Public Prosecutor opposed the bail application and contended that the accused petitioners inflicted the grievous injury by sharp edged weapon on the hand of the complainant Joru.Without making any observation on merits, having considered the rival submissions made at the bar, nature of accusation, material including the cross FIR and the injury reports of the accused persons and the complainant and all other facts and circumstances, I deem it proper to give the benefit of pre-arrest bail to accused petitioners Suresh Sharma and Smt. Suman Devi.In the result, the bail application is allowed and it is directed that in the event of arrest of petitioners Suresh Sharma S/o. Girdharilal Sharma and Smt. Suman Devi W/o. Suresh Sharma, they shall be released on bail by the concerned SHO/Investigating Officer in FIR No. 222/2006 registered at Police Station, Laxmangarh, District Sikar provided each of them furnishes a personal bond in the sum of Rs. 10,000/- together with two sureties each in the sum of Rs. 5,000/- to his satisfaction on the following conditions:- 1. that the petitioners shall make themselves available for interrogation by a police officer as and when required; 2. 10,000/- together with two sureties each in the sum of Rs. 5,000/- to his satisfaction on the following conditions:- 1. that the petitioners shall make themselves available for interrogation by a police officer as and when required; 2. that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer; and 3. that the petitioners shall not leave India without previous permission of the Court. Application allowed. *******
