Vijay v. State Of Haryana

RAJIVE BHALLA

body2006
Judgment 1. The petitioner seeks grant of regular bail in case FIR No.179, dated 12.8.2003, registered under Sections 398/401 of the IPC, and Sections 25/54/59 of the Arms Act, at Police Station Narnaund, District Hisar. Counsel for the petitioner contends that the petitioners coaccused, namely, Balwant Singh and Jagbir Singh, against whom similar allegations have been levelled, have been acquitted by the Additional sessions Judge (Adhoc), Fast Track Court, Hisar, vide judgment dated 17.11.2005 and, therefore, the petitioner be released on bail. Counsel for the respondent, on the other hand, contends that the petitioner was arrested after a period of two and half years and, therefore, he is likely to abscond, if he is released on bail. I have heard learned counsel for the parties and perused the paper book. 2. As the petitioners co-accused have already been acquitted, I find no ground to incarcerate the petitioner any further. Bail to the satisfaction of Chief Judicial Magistrate/duty magistrate, Hisar. The trial Court shall ensure that the trial concludes within a period of six months from the next date of hearing.
