Judgment 1. Prayer in this petition is, for transfer of Sessions Case No.43 of 16.12.2005 titled as `state V. Sohan Lal and others, pending in the Court of sh. L. N. Jindal, Additional District and Sessions Judge, Ambala, to any other court. On the basis of the averments made in the petition and the arguments addressed by counsel for the petitioners, comments of the learned additional District and Sessions Judge, Ambala, were called. The learned additional District and Sessions Judge, Ambala, has emphatically denied, the averments in the petition. However, the Additional District and Sessions judge, Ambala, has prayed that the aforementioned trial be transferred to another Court. It would also be necessary to mention that the trial was originally entrusted to Sh. Sanjeev Kumar Aggarwal, Additional Sessions judge-II, Ambala, who declined to try the case. 2. In this view of the matter but without casting any aspersion upon the judicial officers concerned, the trial of Sessions Case No.43 of 16.12.2005 titled as `state V. Sohan Lal and others stands transferred to the court of the District and Sessions Judge, Panchkula. The Additional District and Sessions Judge, Ambala shall forthwith transmit the file of the case, to the Court of District and Sessions Judge, Panchkula, who shall upon receipt of the file try the case himself or entrust it to any other Additional Sessions judge, as he may deem appropriate. It is further directed that as some of the accused are behind bars, an endeavour be made to conclude the trial, within a period of six months, preferably by holding a day to day trial. Parties are directed to appear before the Sessions Judge, panchkula on 7.8.2006. This petition stands disposed of accordingly.
