Judgment 1. The petitioner filed C. W. P. No.823 of 2003, which was disposed of on January 20, 2003 with a direction to consider his legal notice and dispose of the same by passing a speaking order within three months. Alleging non-compliance of the said order, this contempt petition has been filed. 2. In response to the show cause notice, affidavits have been filed by the President and Executive Officer, Municipal Council, Pathankot. Along with his affidavit, the Executive Officer has appended a copy of the speaking order dated 29.4.2003 (Annexure R-1) which was passed in compliance to the directions issued by this Court. 3. Learned counsel for the respondents, however, refers to the averments made in para 6 of the affidavit of the President of the Municipal council, wherein it is stated that the pension and DA payable to the petitioner are to be released by the Office of Director, Local Bodies, Punjab as he belongs to Provincialised Cadre. 4. After hearing learned counsel for the parties and having regard to the fact that the petitioner is a retiree, who need not be compelled to go for another round of litigation before this Court and also keeping in view that most of his retiral benefits have since been paid, this petition is disposed of with a direction to the Director, Local Bodies, Government of punjab, to consider the reference which he has already received from the municipal Council, Pathankot, in relation to the release of certain retiral benefits to the petitioner and dispose of his claim within three months from the date of receipt of certified copy of this order. However, the petitioner shall be at liberty to send a self-explanatory representation to the Director, local Bodies, Govt. of Punjab along with a certified copy of this order so as to facilitate him to expedite the disposal of his pending claim.
