Judgment :- (Civil Revision Petition filed against the orders passed in I.A.No.9 of 2004 in O.S.No.29 of 2002 on the file of the Principal Subordinate Judge, Myladuthurai against the order dated 1.8.2005.) The above revision is directed against the order of the learned Principal Subordinate Judge, Myladuthurai dated 01.08.2005 made in I.A.No.9 of 2004 in O.S.No.29 of 2002, in and by which the learned Judge dismissed the petition filed under Order 1 Rule 10(2) CPC and Order VIII - A and Section 151 of CPC. 2. Heard the learned counsel for the petitioner/defendant as well the respondent/plaintiff. 3. On going through the averments made in the affidavit filed in support of the said application, the learned Principal Subordinate Judge, after finding that there is no privity of contract or agreement between the respondent/plaintiff with the proposed party, viz., Sree Aravindh Steel Ltd. Company and not even a single paper is filed to show that the amount was transferred to Sree Aravindh Steel Ltd. Company, dismissed the said application for impleading the proposed party. 4. In view of the specific finding by the Court below, in the absence of any other contra material, I do not find any valid ground for interference. In fact, it is pointed out by the petitioner/defendant that in the written statement it is specifically stated that the suit is bad for non-joinder of necessary parties. As rightly observed by the Court below, if the said contention of the petitioner/defendant is proved in the trial, then the person going to be affected is the respondent/plaintiff and not the defendant. In such circumstances and in view of the factual conclusion arrived by the Court below, I do not find valid ground for interference. Accordingly, the revision fails and the same is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
