J.R. Goyal, J.— Heard learned counsel for the accused petitioners, learned Public Prosecutor for the State and perused the case diary. 2. It was contended that accused petitioners Devi Singh is aged 14 years’ a minor boy, and Smt. Kamla Devi is a patient of serious ailment of Cancer. It was also contended that the allegations of harassment and sexual exploitation have been levelled against the co-accused Bhagwan Sahai and Shiv Singh and the accused petitioners have been implicated because they were close relatives of the husband of the complainant. It was also contended that co accused Bhagwan Sahai and Shiv Singh were arrested and enlarged on bail. 3. Learned Public Prosecutor opposed the bail application. 4. Having considered the rival submissions made at the Bar, without making any observation on the merit of the case and keeping in view that no specific allegation has been levelled against the accused petitioner Devi Singh, who is said to be a minor boy of 14 years age, and also keeping in view that accused petitioner Smt. Kamla Devi is said to be sick and Cancer has been detected as the ailment and all other facts & circumstances, I deem it proper to grant the benefit of pre-arrest bail to the accused petitioners. 5. In the result, the anticipatory bail application is allowed and it is directed that in the event of arrest of accused petitioners Smt. Kamla Devi wife of Bhagwan Sahai and Devi Singh son of Bhagwan Sahai, they shall be released on bail by the concerned SHO/Investigating Officer in FIR No. 144/06 registered at Police Station Rajgarh (Alwar) provided each of them furnishes a personal bond in the sum of Rs. 10,000/- together with one surety in the like amount to his satisfaction on the following conditions: - 1.That the petitioners shall make themselves available for interrogation by a Police Officer as and when required: 2. That the petitioners shall not directly or indirectly make any inducement threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or any police officer; and 3. That the petitioners shall not leave India without previous permission of the Court. * * * * *
