ORDER 1. The petitioner is aggrieved on account of willful disobedience of the common order dated 13.10.03 passed in C.W.J.C. No. 11854 of 2001 and C.W.J.C. No. 8314 of 2003. 2. In the aforesaid writ petitions there was dispute in between the petitioner and one Bishwambhar Prasad regarding their inter se transfer from Rural Engineering Organisation, Works Division, Sitamarhi, to R.E.O. works Division, Muzaffarpur. The said writ petitions were disposed of with the direction that the concerned Establishment Committee shall take decision regarding transfer/posting of both Lalan Prasad Sharma and Bishwambhar Prasad and in the result C.W.J.C. No. 11854 of 2001 filed by Bishwambhar Prasad was allowed while C.W.J.C. No. 8314/03 filed by the present petitioner was dismissed with the specific direction that the transfer and posting of the parties shall abide by the decision of the Establishment Committee. 3. A show cause has been filed on behalf of Opposite Party No. 5, Executive Engineer, Rural Engineering Organisation, Works Division, Sitamarhi, annexing the proceeding of the Circle level Establishment Committee on 15.12.2003. From perusal of the proceeding of the Establishment Committee on the said date it is evident that the case of the petitioner as well as Bishwambhar Prasad were considered alongwith that of another Senior Accounts Clerk, Sri Kedar Nath Mishra and decision was taken regarding their transfer and posting as a result of which the petitioner was to remain where from before he was posted. 4. From the aforesaid decision the Establishment Committee which was carried out by issuing office order dated 16.12.03 (Annexure-2) of the contempt petition it is evident that the opposite parties have complied with the directions this Court. As a result there is no merit in this contempt petition and it is accordingly dropped. 5. However the petitioner shall be at liberty take appropriate proceeding against the order impugned if so advised.
