The law of limitation is thus founded on public policy to see that there should be redressal of legal injury suffered by a party but also to see that every legal remedy must be kept alive for a legislatively fixed period of time. Though the condonation of delay is a matter of discretion of the Court but Sec. 5 of the Limitation Act does not say that such discretion can be stretched too far so as to condone any length of time. There has to be rationale criterion as regards exception to the explanation seeking condonation of delay. In some cases, the delay of shortest range may be uncondonable due to a want of acceptable explanation whereas in certain other cases, delay of a very long range can be condoned provided the explanation thereof is satisfactory. The words "sufficient cause" u/S. 5 of the Limitation Act should receive a liberal construction so as to advance substantial justice, but it does not mean to infer that the delay should condoned in each and every case unless discretion exercised by the Court is on untenable grounds or is arbitrary or perverse and in that eventuality, it would be a different matter. While condoning the delay in such cases, the Apex Court has further taken the view that the Court should not forget valuable rights which have accrued to the opposite party altogether. It must be borne in mind that he too is a looser if the delay is condoned whereas he would have incurred huge litigation expenses." 7- geusa vihykFkhZx.k }kjk ÁLrqr ekuuh; mPpre U;k;ky; }kjk jQhd ,.M vuknj cuke~ eqakhyky ,.M vuknj ,-vkbZ-vkj- 1981 ,l-lh- 1400 U;kf;d n`"VkUr dk voyksdu fd;k] ftlesa ekuuh; mPpre U;k;ky; us vfHkfu/kkZfjr fd;k gS ekuuh; mPpre U;k;ky; us jQhd ,.M vuknj cuke~ eqakh yky ,.M vuknj] ,-vkbZ-vkj- 1981 ,l-lh- 1400 esa ;g Áfrikfnr fd;k gS fd& "The disturbing feature of the cause is that under our present adversary legal system where the parties generally appear through their Advocates, the obligation of the parties is to select his Advocate, brief him, pay the fees demanded by him and then trust the learned Advocate to do the rest of the things. The party may be a villager or may belong to a rural area and may have no knowledge of the Courts procedure. After engaging a lawyer, the party may remain supremely confident that the lawyer will look after his interest. At the time of the hearing of the appeal, the personal appearance of the party is not only not required but hardly useful. Therefore, the party having done everything in his power to effectively participate in the proceedings can rest assured that he has neither to go to the High Court to enquire as to what is happening in the High Court with regard to his counsel nor is he to act as a watchdog of the Advocate that the latter appears in the matter when it is listed." ekuuh; mPpre U;k;ky; us ;g Hkh crk;k gS fd & "The problem that agitates us is whether it is proper that the party should suffer for the inaction, deliberate omission or misdemeanour of his agent.
