Heard Mr.Roshni Piba, learned counsel for the petitioner, Mr.Babulindro, learned counsel for respondent nos.1 and 2, Mr.R.S.Reisang, learned GA for respondent nos.3 and 4 as well as Mr.Gopeswar, learned counsel for respondent no.5. [2] The private respondent no.5 has no objection to the setting aside the order issued by the Managing Director, MANITRON, being No.1/2/05(Pt) dated 15th May, 2005 in case the respondent nos.1, 2, 3 and 4 are going to consider the Respondent no.5 for appointment to the post of Technical Assistant (TA) along with other eligible candidates. The learned counsel, Mr.Babulindro appearing for respondent nos.1 and 2 submits that the case of respondent no.5, Shri Kh.Chittaranjan Singh shall be considered for appointment as TA along with other eligible candidates provided he is eligible. After giving such assurance, made by the learned counsel for respondent nos.1 and 2, learned counsel for respondent no.5 frankly submits that the order of the Managing Director, MANITRON dated 16.5.2005 may be quashed. [3] Accordingly, the order of the Managing Director, dated 16.5.2005 is hereby quashed and set aside and respondents are, further directed to consider the petitioner, as assured by the learned counsel for respondent nos.1 and 2 along with the respondent no.5, Shri Kh.Chittaranjan Singh, and other eligible candidates for appointment to the post of Technical Assistants, if eligible, under the relevant Recruitment Rules within a period of 2 (two) months from the date of receipt of certified copy of this judgment and order. With the above observation and direction, writ petition is allowed.
