Judgment 1. Petitioner Kishan Dass, who is husband of the deceased, has filed this petition under Sec.439 Cr. P. C. for grant of regular bail in case fir No.96 dated 26.6.2003 registered under Sec.304-B IPC at Police station Bagha Purana, District Moga. I have heard the counsel for the parties and gone through the contents of the FIR as well as the order dated 9.8.2003 passed by the additional Sessions Judge, Moga, whereby the bail application filed by the petitioner has been dismissed. 2. In this case, within one year of the marriage, the wife of the petitioner died an unnatural death. Keeping in view the nature of allegations against the petitioner, I am not inclined to grant regular bail to him at this stage particularly when the prosecution evidence is at the fag end and one witness is to be examined on 17.10.2006. Dismissed.
