Judgment 1. Appellant- plaintiff filed a suit for recovery of Rs.20,000/-claiming damages for demolition of construction raised by him. The suit was decreed. However, respondents succeeded in appeal. 2. It has been noticed by the appellate Court below that the construction of the boundary wall was demolished under valid order passed by the S. D. M concerned. In the suit, S. D. M was not impleaded as a party.3. In view of the findings given by the appellate Court below in para No.11, no case is made out for interference.
