Victor Ramson and Anr. v. State of Manipur and Ors.

2006-05-04

T.NANDA KUMAR SINGH

body2006
1. Heard Mr.Themreishang Siranao, learned counsel for the petitioners, Mr. R.S. Reisang, learned G.A. appearing for the respondent no.1 and Mr. L. Gunindro Singh, learned counsel appearing on behalf of the respondents 2 and 3. 2. The short factual matrix of the petitioners' case is that on the recommendation of the duly constituted DPC held on 27.11.1998 they were appointed as Assistant Graduate Teachers. 3. It is said that the Govt. of Manipur had taken a policy decision under an order of the Govt. of Manipur dated 19.3.2001 for terminating the services of all the employees who were appointed subsequent to 19.4.1999. Since the writ petitioners had been appointed to the post of Under Graduate Teachers on the recommendation of the duly constituted DPC only on 14.5.1999 they had the apprehension that their services are going to be terminated in pursuance of the order dated 19.3.2001 of the Govt. of Manipur. 4. Mr. R.S. Reisang, learned G.A. and Mr. L. Gunindro Singh, learned counsel appearing for the respondents have frankly submitted that the Govt. of Manipur had already issued an order bearing No.1/15/2000-FC dated 19.6.2002 for changing the cut off date, i.e. 19.4.1999 mentioned in para-1 of the said order of the Govt. of Manipur dated 19.3.2001, to 6.11.1999. The learned GA further submits that such being the situation, the services of the petitioners are not going to be terminated under the said order of the Govt. of Manipur dated 19.3.2001. 5. Taking into consideration of the case of the petitioners as well as the said subsequent order of the Govt. of Manipur dated 19.6.2002, present writ petition is disposed of by directing the respondents not to terminate the services of the petitioners under the said order of the Govt. of Manipur dated 19.3.2001 which has been modified under the said order of the Govt. of Manipur dated 19.6.2002 inasmuch as the petitioners were appointed on the recommendation of the duly constituted DPC held on 27.11.1998 to the posts of Assistant Graduate Teachers as early as 14.5.1999. 6. With the above observation and direction, this writ petition is disposed of. No costs.
