1. Heard Mr. Kh. Tarunkumar Singh, learned counsel appearing on behalf of the petitioners as well as Mr. S. Nepolean Singh, learned Jr.G.A. to the lerned A.G., Manipur appearing for the respondents 1, 2 & 3. 2. Both the parties submit that because of the subsequent order of the Government of Manipur dated 19.6.2002, this writ petition could be disposed of at this stage. 3. The short factual matrix of the petitioners' case is that they on the recommendation of the duly constituted DPC were appointed as Female Health Workers on regular basis in the Family Welfare Department, Govt.of Manipur under order dated 26th October, 1999 of the Director of Family Welfare Services, a copy of which is available at Annexure-A/2 to the present writ petition. It is said that while they were serving as regular Female Health Workers, the Govt. of Manipur issued an order being No.1/15/2000-FC dated Imphal, the 19th March, 2001 to the effect that all the employees who were appointed subsequent to 19.4.1999 shall be terminated. Since the petitioners were appointed on 26.10.1999, they had the apprehension that their services would be terminated under the said order of the Govt.of Manipur dated 19.3.2001. 4. Mr. S. Nepolean Singh, learned Jr.G.A. appearing for the respondents in his usual frankness submits that by a subsequent order of the Govt. of Manipur dated 19.6.2002 the cut off date, i.e. 19.04.1999, mentioned in the said order of the Govt. of Manipur dated 19.3.2001 had been changed to 6.11.1999. Such being the situation, the case of the petitioners who were appointed on regular basis on 26.10.1999 are not going to be terminated under the said order of the Govt. of Manipur dated 19.3.2001. The learned Jr.G.A. also submits that the said subsequent order dated 19.6.2002 is annexed as Annexure-C/1 to the affidavit-in-opposition filed by the state respondents. 5. On perusal of the said subsequent order of the Govt. of Manipur dated 19.6.2002, this writ petition is disposed of by directing the respondents not to terminate the services of the petitioners under the said order of the Govt. of Manipur dated 19.3.2001 inasmuch as the cut off date, i.e. 19.4.1999, had been changed to 6.11.1999. 6. With the above observations and directions, this writ petition is allowed. No costs.
