Judgment R.K. Merathia, J.-Heard. 2. Petitioner is desirous of a direction on the respondents to consider his case for first time bound promotion, after his completion of ten years from 13th July, 1985, when he was appointed on the post of Private Secretary to Chairman-cum-Managing Director and for consequential relief. 3. Petitioner was actually appointed as 'Stenographer' on 16.8.1978 vide Annexure-B, but his case is based on the word "Niyukt" used in the Office Order dated 13th July, 1985 (Annexure-1), by which he was actually promoted to the post of Private Secretary to the Chairmancum-Managing Director. 4. It appears from the resolution of the respondents that it was decided to fill up the said post of Private Secretary to the Chairman-cum-Managing Director by promotion. From the representations of the petitioner also it appears that he was promoted on 13th July, 1985.' Only because the word "Appointed on the post of Private Secretary to the Chairman-cum-Managing Director" is used in Annexure-1, it cannot be said that petitioner was appointed on 13th July, 1985 and, therefore, he became entitled to first time bound promotion after completion of ten years thereafter. 5. From the records, it is clear that petitioner was appointed on 16.8.1978 and he got substantive promotion on 13th July, 1985. 6. In the circumstances, petitioners' contention that he is entitled to get first time bound promotion from July, 1995, as he was appointed on 13th July, 1985 is wholly misconceived. 7. In the result, I find no merit in this writ petition, which is, accordingly, dismissed. However, there will be no order as to costs.
