The Deputy Colonisation Commissioner is not a Collector under the provisions of the Rajasthan Tenancy Act. The powers of Collector under Section 232 of the Rajasthan Tenancy Act has been delegated to the Colonisation Commissioner as per the notification of the State Government dated 15.1.1992 bearing notification No. F.4(vi) colo/91 which has been published in the Rajasthan Gazette on 13.12.92 at page No. 967. Therefore, the Deputy ` Commissioner, Bikaner is not competent to make the reference. 9- ge vizkFkhZ ds fo}ku vfHkHkk"kd ds bl rdZ ls Hkh lger gS fd %& That the proceeding under Section 232 of the Rajasthan Tenancy Act were initiated by the Colonisation Commissioner, Bikaner but later on it was transferred to the Deputy Colonisation Commissioner, Bikaner. In this respect, it is humbly submitted that neither the Court of Colonisation Commissioner was competent to transfer the case to any officer subordinate to him nor the transferee Court was competent to decide the reference, because the Colonisation Commissioner is the delegate of the powers of the Collector for the purpose of Section 232 of the Rajasthan Tenancy Act and a delegate cannot delegate his power further to any other person. Therefore, the Whole proceedings are vitiated. Therefore, the reference order of the Deputy Colonisation Commissioner deserves to be quashed and set aside. 10- blds vfrfjDr vizkFkhZ ds fo}ku vfHkHkk"kd dk ;g rdZ Hkh dkuwu laxr gS fd %& That even looking to the cases from another angle, the reference is not maintainable. The Collector is competent to make a reference against the order passes by the Court of officers subordinate to him. The Assistant Colonisation Commissioner is not subordinate to the Deputy Colonisation Commissioner because the Assistant Colonisation Commissioner, Kolayat has been delegated the powers of Collector under Section 2(1) of the Rajasthan Colonisation Act, 1954 and therefore, he is not subordinate to the Deputy Colonisation Commissioner. That under the Rajasthan Tenancy Act, the Deputy Colo nation Commissioner has also been delegated the power of Assistant Collector and the Assistant Colonisation Commissioner has also been delegated the powers of Assistant Collector and, therefore, one is not subordinate to another and, therefore, the reference is incompetent and, therefore, cannot be entertained.
