ORDER : UPON hearing counsel the Court made the following I.A. No.22 1. Pursuant to the directions issued by this Court on the last date of hearing, Affidavit dated 8th May, 2006 has been filed by Municipal Corporation of Delhi, wherein it has been stated that the order for the third plant and machinery has been placed on M/s Food Processing Equipment Company Pvt. Ltd. Counsel appearing for the contractor accepts this statement and assures that the contractor would place the order with the German firm within two days from today and try to import the machinery at the earliest possible. 2. The machinery, which were lying at Tughlakabad, New Delhi for clearing by Custom Authorities, has been got cleared and put at site. M/s Food Processing Equipment Company Pvt. Ltd., the Contractor, is directed to install the said machinery immediately after completing the civil work. The Contractor is further directed to renew the existing bank guarantee (s) for a period of three months from the date of expiry of the bank guarantee(s). 3. It has been further stated in the affidavit filed by the MCD that for the increased capacity of the Effluent Treatment Plant, additional land has been acquired and possession taken. Tenders have been invited for the construction of the increased capacity of the Effluent Treatment Plant and shall be completed simultaneously with the rest of the project. 4. MCD is directed to carry out an inspection of the works, already completed and which are going to be completed after installation of the machinery, as directed above, by 30th June, 2006 and file a Status Report. If after inspection MCD finds that works have been completed and the goods have been received to its satisfaction, it may release the amount, if any due, to the contractor as per clause 4 of the Payment Terms. 5.
