ORDER BLAPL No.9038 of 2006 (In connection with S.T. Case No.77/21 of 1990 pending before the Addl.Sessions Judge, Bargarh) Heard learned counsel for the petitioner and learned counsel for the State. Perused the materials available in the Case Diary. 2. The petitioner is facing trial for alleged commission of offence under Section 302 IPC. It is specifically alleged that though the case is being posted to several dates due to non-apperance of the I.O. as a witness in the case the case is lin¬gering, thereby greatly prejudicing the petitioner. Learned counsel for the petitioner therefore prays that the petitioner may be directed to be released on bail in such circumstances. 3. After hearing the learned counsel for the parties, this Court feels that the trial is at the fag-end and due lackadaisi¬cal attitude of the concerned I.O. the case is unnecessarily lingering. It appears from records that though the Court below had requested the I.G. of Police to direct the said I.O. to appear in Court, even then the I.O. is not appearing in Court. Taking a serious view, this Court directs the I.O. to positively appear before the Court below on the next date to which the case is posted. A copy of this order be supplied to the State counsel who will communicate the same to the concerned I.O. for strict compliance with the aforesaid direction of this Court. The BLAPL is accordingly disposed of. BLAPL disposed of.
