ORDER Heard Learned counsel for the petitioner and the State. 2. Petitioner served as a Store Keeper in the Bihar Institute of Silk and Textile at Nathnagar, Bhagalpur. His payment of retiral dues was not being cleared earlier as it was said that he had not made over charge of the store which was under his control before reaching the age of superannuation. Now, it is evident that petitioner has made over charge of the store and pursuant to handing over charge his retiral dues have been cleared except salary for the period 1st February, 1998 to 15th September, 1998 on the ground that during the said period he never reported for duty and remained under unauthorized absence. Till date no proceeding for such unauthorized absence has been initiated against the petitioner. 3. In the circumstances, after retirement of the petitioner as also after clearing his retiral dues including arrears of pension, the authorities would not be well advised to initiate proceeding for such unathorized absence and they should clear the payment of arrears of salary for the said period without any further delay. Accordingly, respondent authorities are directed to release the salary of the petitioner for the aforesaid period from 1st February, 1998 to 15th September, 1998 within a period of three months from the date of receipt/production of a copy of this order. 4. This application is disposed of. No cost.
