Judgment 1. Judgment: vide order under challenge, application of the petitioner defendant to amend his written-statement was dismissed. It has been noticed by the Court below that when suit has matured for arguments, the application for amendment was moved. It has also been observed by the Court below that the fact, which the petitioner now intends to incorporate in his written-statement, was very much within his knowledge, at the time of filing written-statement.
