ORDER : In all matters, except T.P. (C) No.450 of 2004 1. Heard Mr. Mohan Parasaran, learned Additional Solicitor General, Mr. K.K. Venugopal, learned senior counsel, and Mr. Prashant Bhushan, learned counsel. 2. Though the challenge in the writ petitions and transferred cases is to the constitutional validity of MPLAD Scheme, during the course of arguments, it has transpired that substantial questions of interpretation of Articles 275 and 282 of the Constitution of India are involved, particularly in regard to transfer of funds from the Union Government to the State Governments. The interpretation is also required to be placed on various other provisions of Chapter I of Part-XII of the Constitution of India relating to finance, property, contracts and suits. In this view, it would be appropriate if the matters are heard by a Constitution Bench at an early date. 3. Ordered accordingly. 4. The Registry shall place the papers before Hon'ble the Chief Justice of India for directions. Transfer Petition (C) No. 450 of 2004: 5. In the meantime, service upon the sole respondent in Transfer Petition (C) No.450 of 2004 be completed. If the service is effected, list the transfer petition along with Writ Petition (C) No.21 of 1999 before the Constitution Bench.
