ORDER 1. Petitioner is challenging Annexure-F appointing the president, secretary and member as an official committee for the management of Hazrat Noor Ali Shah Makan, Mysore and also notice issued by the Dist. Wakf Officer as per Annexure-E dated 2-5-2003 calling upon the occupants of the building to pay rents to the Dist. Wakf Officer. According to the petition averments, Makan in question is not the wakf property and managed by the Karnataka State Board of Wakf, is bad in law and notice issued by the Dist. Wakf Officer calling upon the occupants of the property to pay rents is also bad in law. According to him, he is managing the Makan and therefore his right should not be curtailed by the Wakf Board. Considering the fact that the appointment of the committee by the Wakf is in respect of the Makan. This Court is of the opinion that petitioner has to file an application before the Wakf Tribunal, Mysore and that the writ petition is not maintainable. 2. Accordingly, this petition is dismissed. However, liberty is granted for the petitioner to file an application before the tribunal within 8 weeks from today. Till such date, interim order granted earlier shall be continued. 3. Order accordingly.
