Jameel Ahmed v. Board of Secondary Education

2006-03-07

K.S.RATHORE

body2006
JUDGMENT 1. - The only controversy in this writ petition is with regard to correction of father's name in the certificates of Secondary and Higher Secondary Examination. 2. By mistake, in the aforesaid certificates, instead of petitioner's father name Fateh Mohammed, his brother's name Jahangir Chandel has been mentioned. For correction, the petitioner moved before the Board of Secondary Education. As per provisions of Chapter 25 of Hand Book, after lapse of 5 years, no such correction can be made by the Board of Secondary Education, therefore, the request of the petitioner was turned up (sic. down?). 3. I have carefully perused the relevant provisions, which of - course stipulates that corrections can only be made within a period of five years. Since the petitioner only seeks correction of his father's name, which will not adversely affect the interest of the Board rather on the contrary it will affect the interest of the petitioner. Looking to the facts and circumstances of the case and in the interest of justice, I deem it proper to direct the respondent Board of Secondary Education, Ajmer to carry out the necessary corrections in the certificate and shall issue fresh certificates after correcting the name of petitioner's father. With the aforesaid observation, the writ petition stands disposed of.Writ petition allowed as above. *******
