JUDGMENT Hon’ble S.P. Mehrotra, J.—The case is listed today under Chapter XII, Rule 4 of the Rules of the Court with the Office Report dated 6.3.2006 on account of the failure on the part of learned Counsel for the plaintiff-appellant to take requisite steps pursuant to the order dated 1.12.2005 passed on the following applications: 1. Civil Misc. Delay Condonation Application No. 207698 of 2003 2. Civil Misc. Substitution Application No. 207700 of 2003 2. It may be mentioned that the aforementioned applications have been filed consequent to the death of Nathoo Ram, the sole defendant-respondent. 3. The case has been taken up today in the revised list. Learned Counsel for the plaintiff-appellant-applicant in the aforementioned applications is not present. 4. Despite the case having been listed today under Chapter XII, Rule 4 of the Rules of the Court, steps have not been taken for issuance of notice, pursuant to the order dated 1.12.2005 passed on the aforementioned applications. 5. In the circumstances, the Court has no option but to dismiss the aforementioned applications for want of prosecution under Chapter XII, Rule 4 of the Rules of the Court. 6. The aforementioned applications are, accordingly, dismissed for want of prosecution under Chapter XII, Rule 4 of the Rules of the Court. 7. In view of the dismissal of the aforementioned applications filed consequent to the death of Nathoo Ram (defendant-respondent), the Second Appeal as against Nathoo Ram (defendant-respondent) stands abated. 8. In view of the fact that the said Nathoo Ram was the sole defendant-respondent, the Second Appeal stands dismissed as having abated. ————
