Heard Mr.Y.Nirmolchand, learned counsel for the petitioner as well as Mr.Nepolean, learned GA for all the respondents. [2] By this writ petition, the petitioner is asking for a direction to the respondents to implement the earlier order of the learned Single Judge dated 31.8.2001 in the WP(C) No.86 of 2001 filed by the present petitioner. The said earlier order of this court dated 31.8.2001 passed in WP(C) No.86 of 2001 reads as follows: “ Heard Mr.BP Sahu, learned Advocate for the petitioner, and Mr.Nimaichand, learned Govt.Advocate for the Respondents. This writ application shall stand disposed of with the direction that the case of the petitioner for regularization shall be considered in terms of Annexure-A/8, the order by which the persons junior to the petitioner have been regularized. Similar benefit shall be given to this petition also. This shall be done within a period of three months.” [3] It is also stated that against the earlier judgment and order of the Learned Single Judge dated 31.8.2001 passed in WP(C) No.86 of 2001 the State Government had preferred an appeal being WA No.37 of 2002 before the Division Bench and the Division Bench also dismissed the Writ Appeal No.37 of 2002 by passing final judgment and order dated 13.09.2004, copy of which is available at Annexure-A/6 to the present writ petition. The learned counsel for the petitioner submits that no SLP had been preferred by the State respondents against the judgment and order of the learned Single Judge dated 31.8.2001 passed in WP(C) No.86 of 2001 which has been confirmed by the learned Division Bench by passing judgment and order dated 13.9.2004 in WA No.37 of 2002 under which the Writ Appeal has been dismissed. Such being the situation, this court is of the considered view that at present the earlier judgment and order of the learned Single Judge dated 31.8.2001 passed In WP(C) No.86 of 2001 which has been confirmed by the order of the learned Division Bench dated 13.9.2004 in WA No.37 of 2002 had attained finality. [4] Such being the situation, this writ petition is disposed of with the direction to the respondents to implement the earlier order of this court dated 31.8.2001 passed in WP(C) No.86 of 2001 within 4 (four) months from the date of receipt of certified copy of the judgment and order. To the extent indicated above, writ petition is disposed of.
