Without going to the merits of the application for rejection of plaint, it may be stated at this stage itself that the preliminary objection was rightly rejected by the Honble Single Judge. Order 7 Rule 11, C.P.C. as already observed, casts a duty upon the Court to reject a plaint if the circumstances indicated therein were existing. It cannot be the law that this power of the Court would be curtailed in and manner simply because the Court had proceeded to some length, without application of mind on this point. The rule itself does not indicate anywhere that the power is to be exercised upon an application, or if such an application is filed it should be at any particular stage. We must and do agree that the opinion of the Honble Single Judge that the preliminary objection regarding the state of moving an application under Order 7 Rule 11, C.P.C. was not acceptable.
