NARAYAN ROY

body2006
Judgment 1. Heard counsel for the parties. 2. The petitioners pray for issuance of direction upon the respondents to pay their remunerations for the posts they are holding. 3. It is submitted by learned counsel for the petitioners that the petitioners are till date working on daily wages, but their remunerations are not being paid. 4. In the counter affidavit filed on behalf of respondent no. 8, it is stated that the petitioners were disengaged by the District Magistrate some time in the year 2003 and their remunerations were paid till the date of their disengagement. So far petitioner nos. 2 and 3 are concerned, they are again said to have been engaged by the Bihar Education Project and they are being paid their wages. 5. Learned counsel for the State at the same time submits that the scheme under which the petitioners were working is no more in existence, and, therefore, no question arises for taking work from the petitioners and for payment of their remunerations. 6. In the given facts and circumstances of the case, in my opinion, the petitioners should place their grievances before the District Magistrate, Muzaffarpur, respondent no. 8, by a detailed representation and in case such a representation is filed by the petitioners, the same would be examined and disposed of by speaking order by the District Magistrate, respondent no. 8, in accordance with law within a period of six weeks from the date of its filing. 7. With the direction/observation aforesaid, this application is disposed of.
