( 1 ) NONE is present on behalf of the plaintiffs-appellants. ( 2 ) THE case is listed today before the Court under Chapter XII, Rule 4 of the Rules of the Court on account of failure on the part of the learned counsel for the plaintiffs-appellants in taking requisite steps for issuance of notice to the defendant-respondent Nos. 1 and 2 by Registered Post A. D. , pursuant to the order dated 04-01-2006. Even though the case is listed today under Chapter XII, Rule 4 of the Rules of the Court, requisite steps have not been taken on behalf of the plaintiffs-appellants. As noted above, none is present on behalf of the plaintiffs-appellants even when the case has been taken up in the revised list. ( 3 ) IN the circumstances, the Court has no option, but to dismiss the Second Appeal, as against the defendants-respondents Nos. 1 and 2 under Chapter XII, Rule 4 of the Rules of the Court for want of prosecution. ( 4 ) THE Second Appeal is accordingly dismissed, as against the defendants-respondents Nos. 1 and 2 under Chapter XII, Rule 4 of the Rules of the Court for want of prosecution. As the defendants-respondents Nos. 1 and 2 are the only respondents in the Second Appeal, the Second Appeal stands dismissed under Chapter XII, Rule 4 of the Rules of the Court for want of prosecution. .
