JUDGMENT Hon’ble S.P. Mehrotra, J.—Case called out in the revised list. 2. None is present on behalf of the plaintiffs-appellants. 3. The case is listed today before the Court under Chapter XII, Rule 4 of the Rules of the Court on account of failure on the pail of the learned Counsel for the plaintiffs-appellants in taking requisite steps for issuance of notice to the defendant-respondent Nos. 1 and 2 by Registered Post A.D., pursuant to the order dated 4-1-2006. 4. Even though the case is listed today under Chapter XII, Rule 4 of the Rules of the Court, requisite steps have not been taken on behalf of the plaintiffs-appellants. 5. As noted above, none is present on behalf of the plaintiffs-appellants even when the case has been taken up in the revised list. 6. In the circumstances, the Court has no option, but to dismiss the Second Appeal, as against the defendants-respondents Nos. 1 and 2 under Chapter XII, Rule 4 of the Rules of the Court for want of prosecution. 7. The Second Appeal is accordingly dismissed, as against the defendants-respondents Nos. 1 and 2 under Chapter XII, Rule 4 of the Rules of the Court for want of prosecution. 8. As the defendants-respondents Nos. 1 and 2 are the only respondents in the Second Appeal, the Second Appeal stands dismissed under Chapter XII, Rule 4 of the Rules of the Court for want of prosecution.
