ORDER 1. Heard. This is first bail application under section 438, CrPC. Crime No. 160/ 2005 is registered against the present applicant for committing offence under sections 374, 323/34 of IPC and section 3(1) (X) of SC/ST (Prevention of Atrocities) Act. 2. The offences under sections 374 and 323 are bailable offence. As regards offence under section 3 (1) (x) is concerned, as per the FIR the present applicant has advanced an amount of Rs.2,000/- to the complainant, where he was serving with the present applicant. There was dispute about the amount advanced by the present applicant, due to which the present complaint is lodged. Thus from perusal of FIR and allegations made against the present applicant, the offence under section 3 (1) (x) of the SC/ST of (Prevention of Atrocities) Act is not made out. Moreover, the complainant has filed an affidavit (Annexure D-l) before this Court in which he has stated that the applicant has not committed any offence. 3. Considering these facts, I allow this application and direct that in the event of arrest, the applicant be released on bail on her furnishing a personal bond in the sum of Rs. 20,000/- (Rupees twenty thousand only) with one solvent surety in the like amount to the satisfaction of the arresting authority. This order shall remain in force only for a period of 30 days from today. In the meantime, the applicant may file an application for regular bail before the concerned Court, which shall be decided by the trial Court on its merit. In case, if any, adverse order is passed on the application, the said order shall not be given effect to for a period of 15 days thereafter. Certified copy as per rules.
