Judgment 1. Heard. 2. Offence alleged is under sections 420/467/468/471/506/120-B IPC. Case of the prosecution is that Pala Ram and Baljit Singh unauthorizedly sold property belonging to the complainant on the basis of power of attorney executed by Smt. Rajo by impersonating as sunehari Devi complainant. 3. Counsel for the petitioner submits that Pala Ram, Baljit Singh and Rajo have been arrested and are in custody and Mai Chand, in whose favour sale deed has been executed, has also been granted anticipatory bail. 4. It is pointed out that the petitioner is a Lambardar and he merely identified Rajo as Sunehari Devi without any fraudulent intention, as he believed that Rajo was Sunehari Devi. It is also pointed out that in any case, the petitioner is willing to face prosecution and join investigation and has not got any benefit out of the transaction. It is also submitted that the persons, who have got benefit out of the transaction, have either been arrested or granted bail. 5. Without expressing any final opinion on merits, the petitioner is granted anticipatory bail till conclusion of investigation or three months whichever is later during which the petitioner will be free to apply for regular bail to the concerned court in accordance with law. 6. In the event of arrest, the petitioner will be released on bail on furnishing bail bonds to the satisfaction of the arresting officer within two weeks from today on the conditions that the petitioner will not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; he will not interfere with the prosecution evidence directly or indirectly; he will not leave the country without the previous permission of the court; he will associate with the investigation as and when called by the police and that he will surrender the passport, if any. The petition is disposed of accordingly.
