JUDGMENT S. B. ROY, C.J. : None is available for the parties. This appeal at the instance of the appellant being the Town Surveyor authorised by the Executive Officer, Berhampur Munici¬pality is directed against the judgment dated 24.10.1987 passed by the learned Judicial Magistrate, Second Class, Berhampur in 3(a) C.C. No.64 of 1986 acquitting the respondent from the charge under Section 385-A of the Orissa Municipal Act. 2. Undoubtedly the offence is of petty nature. Since this appeal was filed in this Court in 1988, almost 18 years’ time has elapsed. After this inordinate delay on our part to dispose of this appeal within a reasonable period of time, it appears to me that it will be travesty of justice to alter the finding of acquittal into one of conviction. Consequently, the appeal is dismissed. Appeal dismissed.
