Judgment 1. This order will dispose of Criminal Misc. Nos.61723-M and 70249-M of 2005. Heard. 2. Offence alleged is under sections 302/34 IPC. Case of the prosecution is that on 17.3.2005, Nathi Ram, Naib tehsildar, was killed and his dead body was recovered. As per version given by Reader of the deceased, Vedpal, the deceased was being threatened soon before his death by his Peon Raj Kumar and Vikas and Chetan, who were son and associate of the said Raj Kumar, on account of dispute over return of loan advanced by the deceased. On the basis of circumstantial evidence, Raj kumar, Vikas and Chetan are being proceeded against. 3. In support of prayer for bail qua Chetan, it is submitted that he has been found to be juvenile and as per report of the Probation officer, there is no clear finding that he is likely to join association of any criminal or is likely to expose him to moral, psychological or physical danger. 4. Father of Chetan, who is present in court, says that he will keep Chetan in his care. Without expressing any opinion on merits, Chetan accused is granted bail under the provisions of section 12 of the Juvenile Justice (Care and Protection of Children) Act, 2000, to the satisfaction of CJM/ Duty magistrate, Hisar. 5. As regards Raj Kumar petitioner, no ground is made out for grant of bail at this stage. Prayer qua Raj Kumar is declined. Both the petitions are disposed of accordingly. The trial may be expedited.
